These General Terms and Conditions of Sale (hereinafter "GTC") govern the contractual relationship between any person visiting or making a purchase on the website www.tscoccoon.com(hereinafter "the Customer" or "you") and the company [Company Name, legal form, share capital], whose registered office is located at [Registered Office Address], registered with the RCS of [RCS City] under the number [RCS Number], and whose intra-community VAT number is [Intra-community VAT number if applicable] (hereinafter "TS Coccoon" or "we").
By placing an order on our site, you acknowledge having read, understood, and unreservedly accepted these GTC.
ARTICLE 1 – SUBJECT
These GTC define the rights and obligations of the parties within the framework of the sale of products offered by TS Coccoon to the Customer on the website www.tscoccoon.com. They apply without restriction or reserve to all sales concluded between TS Coccoon and the Customers.
ARTICLE 2 – PRODUCTS
The products offered for sale are those described and presented on the website www.tscoccoon.com, within the limits of available stock. TS Coccoon takes the greatest care in presenting the products to meet the requirements of article L. 111-1 of the French Consumer Code. The photographs and descriptions of the products are as accurate as possible but cannot ensure a perfect similarity with the delivered product, particularly regarding colors or natural materials (e.g., wood grain).
ARTICLE 3 – PRICES
The prices of the products are indicated in Euros (€) inclusive of all taxes (TTC/VAT), excluding delivery costs. Delivery costs are calculated according to the destination and weight of the items and are indicated to the Customer before the final validation of their order. TS Coccoon reserves the right to modify its prices at any time, it being understood that the price displayed on the site at the time of the order will be the only one applicable to the Customer.
ARTICLE 4 – ORDER
4.1. Order process The Customer selects the products they wish to purchase and adds them to their cart. The Customer can at any time check the details of their order, its total price, and correct any errors before validating it.
4.2. Order validation The validation of the order implies the irrevocable acceptance of these GTC. The Customer must follow the payment steps to finalize their order. Any validated order is subject to a confirmation email summarizing the details of the order.
4.3. Product unavailability In case of unavailability of a product after validation of the order, the Customer will be informed by email or telephone as soon as possible. The order will be canceled, and the Customer will be refunded the sums paid without delay, at the latest within fourteen (14) days following the cancellation.
ARTICLE 5 – TERMS OF PAYMENT
Payment is made by bank card (Visa, MasterCard, American Express) with Shopify Payments. Payments are secured by our partner Shopify Payments. The information transmitted is encrypted and cannot be read during transport on the network.
ARTICLE 6 – DELIVERY
6.1. Delivery zones Products are delivered to the delivery address indicated by the Customer during the order, within the geographical area covered by our services [Specify zones: e.g., Metropolitan France, Europe, Worldwide].
6.2. Delivery times Delivery times are given for information purposes only and vary depending on the carrier and the destination. They are communicated to the Customer before the validation of their order. TS Coccoon cannot be held responsible for delivery delays attributable to the carrier.
6.3. Order reception It is the Customer's responsibility to check the condition of the products upon receipt of the order. In case of missing or damaged products, the Customer must formulate precise and motivated reservations with the carrier on the delivery note and inform TS Coccoon within [Number] business days following reception.
ARTICLE 7 – RIGHT OF WITHDRAWAL
In accordance with the legal provisions in force, the Customer has a period of fourteen (14) days from the receipt of the products to exercise their right of withdrawal, without having to give reasons or pay penalties. Products must be returned in their original and complete condition (packaging, accessories, instructions...) allowing their commercialization in new condition. Return costs are borne by the Customer.
To exercise this right, the Customer must notify their decision to withdraw to TS Coccoon by email at [Customer service email address] or via the site's contact form.
ARTICLE 8 – WARRANTIES
All products sold by TS Coccoon benefit from the legal guarantee of conformity (articles L. 217-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
In case of non-conformity of a product sold, it may be returned, exchanged, or refunded.
ARTICLE 9 – LIABILITY
TS Coccoon cannot be held liable for any inconvenience or damage inherent in the use of the Internet, particularly a break in service, external intrusion, or the presence of computer viruses.
ARTICLE 10 – INTELLECTUAL PROPERTY
All elements of the site www.tscoccoon.com(texts, images, logos, icons, sounds, software...) are and remain the exclusive intellectual property of TS Coccoon or its partners. Any reproduction, representation, modification, publication, or adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited, except with the prior written authorization of TS Coccoon.
ARTICLE 11 – PERSONAL DATA
TS Coccoon undertakes to protect the confidentiality of the information provided by the Customer. All personal information collected is processed in accordance with our Privacy Policy, available on the site. In accordance with the General Data Protection Regulation (GDPR), the Customer has a right of access, rectification, deletion, and opposition concerning their personal data.
ARTICLE 12 – APPLICABLE LAW AND DISPUTES
These GTC are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.
